Your rights
There are times when people are unable to pay their debts, and get behind with payments to their mortgage company, auto lender, or credit card companies. As a result of late payments, they receive many harassing phone calls, at home and work, or letters from creditors threatening a lawsuit and garnishment of wages.

Fortunately, federal law helps people with overwhelming debts. Such help may be through filing bankruptcy. The two most common forms of bankruptcy are Chapter 7 and Chapter 13.

Chapter 7 offers people the chance to “discharge” certain debts. A discharge is a court order that stops all collection efforts of your creditors and wipes out your obligation to repay. You may be allowed to keep your home, vehicle and other types of property that are necessary to maintain your household or job. You may even be allowed to pick and choose which debts you want to keep.

Chapter 13 is a reorganization for people instead of businesses. In chapter 13, people with stable income, and with unsecured debts less than $250,000 and secured debts less than $750,000 may make a repayment plan to pay their creditors over time. You can make one monthly payment to a trustee who then pays your creditors under the plan. The plans can vary in length and even back taxes and student loans can be paid out over time.
