The personal injury practice of Burton & Associates, P.C. encompasses a wide range of cases that we handle. Basically, if you have been the victim of someone else's negligence, we would like to help you recover for it. Your rights
You have been injured due to the negligence of another party. What now? To begin with, there are some things you must know and do.

You do not automatically receive money damages as a matter of right. What you do have is (a) the right to make a claim and a chance to prove, by evidence, that the incident was solely caused by others, and (b) the chance to prove, by evidence, your injuries and damages.

We make every effort to settle your claim without the necessity of litigation; however, some cases ultimately must be litigated. Initially, we will notify the person or entity who may be at fault and their insurance company. Then there will be a period of time in which further investigation will be made by both sides. During this time, we may ask for periodic medical reports so that we can follow the progress of your physical health. Also, during this period, you may be asked to give your statement, to us or an adjuster, concerning the facts surrounding your case. We will explain this to you in greater detail when this is scheduled and of course, we will be with you when you give your statement.

Remember, everything you do or say can and probably will be used against you. Likewise, what you do may be evidence which will help prove your claim.

So, the job of proving your claim is yours and, if we become your representative, it is also our job. Those you believe caused the accident, their insurance agents, adjustors, and lawyers will be picking at anything you do and say in an effort to disprove your claim.

Keep in mind that insurance agents, adjusters and their lawyers are specifically trained to pay you the smallest amount possible on your claim and, if possible, to beat your claim. Even your own insurance agent may be torn between feelings for his company and the insurance industry as a whole on the one hand, and your rights on the other.

The problems of gathering your evidence are many, and the laws which apply to your claim are not simple. It will take time, but a fair settlement is most likely to follow if your case is well prepared and the other side can see that you are well prepared.
